Source text - French Présentation du mécanisme des conventions triparties et de leur conséquence sur les tarifications appliquées par les établissements
Les établissements médico-sociaux qui accueillent des personnes âgées remplissant les conditions de perte d’autonomie mentionnées à l’article L.232-2 du Code de l’Action Sociale et des Familles (« CASF ») ouvrant droit au versement de l’allocation personnalisée d’autonomie (« l’APA ») doivent signer au plus tard le 31 décembre 2007 une convention tripartite, avec le Conseil général et l’État. A défaut d’une telle signature, ceux-ci ne peuvent pas bénéficier du statut d’EHPAD et ne pourront donc plus accueillir des personnes âgées dépendantes à partir du 1er janvier 2008. Cette réforme importante a mis en place un nouveau mode de tarification, remplaçant l’ancien système dans lequel les EHPA facturaient deux tarifs :
• un forfait hébergement « gîte et couvert », fixé librement par l’établissement et acquitté par le résident ;
• un forfait dépendance, d’un montant déterminé par le Conseil général et lié au degré de dépendance du résident ; il est payé par ce dernier, qui peut prétendre à l’allocation personnalisée d’autonomie.
La convention tripartite prévoit une décomposition des tarifs des EHPAD en 3 parties :
• un tarif journalier afférent à l’hébergement, qui comprend l’ensemble des prestations d’administration générale, d’accueil, de restauration, d’entretien et d’animation de la vie sociale de l’EHPAD, dont le montant est fixé librement par l’établissement, mais dont la réévaluation annuelle est décidée par arrêté du Ministre de l’Economie et des Finances. Ces frais sont à la charge du résident, sauf dans le cas particulier des résidents bénéficiant de l’aide sociale ;
• un tarif journalier afférent à la dépendance, fixé par le Conseil général et qui recouvre l’ensemble des prestations d’aide et de surveillance nécessaires à l’accomplissement des actes essentiels de la vie, et qui ne sont pas liées aux soins ; ce tarif est acquitté par le résident, qui selon son niveau de dépendance et ses revenus pourra bénéficier de l’APA, telle que décrite ci-dessous ;
• un tarif journalier afférent aux soins, fixé par la DDASS après avis du Conseil général et la Caisse régionale d’Assurance maladie qui correspond aux prestations médicales et paramédicales nécessaires à la prise en charge des affections des résidents. Il est versé directement par l’Assurance maladie aux établissements, dans le cadre d’une enveloppe budgétaire globale, en fonction du niveau de médicalisation de chaque établissement. En revanche, les médicaments restent la plupart du temps à la charge du résident.
La règlementation des tarifs est étroitement liée au contexte politique et social, et est susceptible de varier en fonction de l’orientation donnée à la politique de soins. Notamment, l’Assurance maladie décide de l’évolution des dépenses de soins et les Conseils généraux sont compétents pour les tarifs de la dépendance.
Translation - English Overview of the tripartite agreement system and its effect on rates set by centres
Nursing homes for the elderly who fulfil the dependency requirements set forth in Article L.232-2 of the French Code de l’Action Sociale et des Familles (CASF) entitling them to the Allocation Personnalisée d’Autonomie (APA) allowance must sign a tripartite agreement with the Conseil Général and the French government by 31 December 2007 at the latest. Facilities that fail to do so cannot benefit from EHPAD status, and will no longer be authorised to provide care for dependent elderly residents as of 1 January 2008. This major reform has established a new rate-setting method which replaces the two-tiered rate system formerly applied by the EHPA:
• a "board and lodging" fee, freely established by the facility and paid by residents.
• a fixed dependency fee, the amount of which was determined by the Conseil Général and based on the resident’s degree of dependency; this fee was paid by residents, who may also be eligible for the APA allowance.
The tripartite agreement provides for a breakdown of EHPAD rates into three distinct fees:
• A daily accommodation fee, including all costs related to general administration, reception, food service, handling, maintenance and social activities within the EPAD home, freely set by the centre, but subject to yearly adjustments in accordance with an order by the French Ministry of the Economy and Finance. This fee must be paid by the residents, except those who receive Social Security benefits.
• A daily dependency fee, set by the Conseil Général, which covers all costs for the assistance and surveillance needed to accomplish basic everyday, non-healthcare-related tasks; it must be paid by the residents, who may, however, receive the above-mentioned APA allowance if they meet the dependency and income requirements.
• A daily healthcare fee, established by the French DDASS (Departmental Board of Health and Social Action) following recommendations by the Conseil Général and the Caisse régionale d’Assurance Maladie (Regional Health Insurance Fund) for all medical and paramedical care provided to residents. This fee is subsidised by a general budgetary allowance paid directly by the Caisse d'Assurance and determined by an evaluation of the level of medical care provided in each facility, depending on the residents’ healthcare needs. The cost of medication, however, must usually be covered by the residents themselves.
Regulations concerning rates are determined by the political and social climate, and may vary in accordance with changes in healthcare policy. The Caisse d'Assurance is responsible for changes in spending, and the Conseils Généraux determine dependent care rates.
