Italian to English Law/Patents Law (general) Divorce Judgement/Decree
This follows on from the paragraph posted in my earlier question on this very short divorce document:

"ritenuta l'equità e la congruita delle condizioni concordate, di cui al ricorso depositato, anche con riferimento agli interessi dei figli minori (se vi sono);
tenuto conto che se le parti hanno concordato trasferimenti immobiliari, la sentenza e esclusivamente costitutiva del divorzio (scioglimento o cessazione degli effetti civil) restando escluso che la stessa possa costituire titolo per I detti trasferimenti, ne accertamento della consistenza degli immobili, ne della loro trasferibilita, ne della validita degli accordi."

I do not really understand these property details.

... of land (includes buildings in English law).

> restando escluso che la stessa possa costituire titolo per I detti trasferimenti : there being no way that the decree on its own can operate as a 'muniment of title' (atto; documento probatorio, Garzanti) to effect such transfers of real estate / land (immobiliari) - IMO meaning extra docs. & deeds will be required for the purpose.

In England & Wales, if one party to marriage refuses to transfer property to the other, the judge can direct 'Conveyancing Counsel' in Chancery to carry out the transfer and HM Land Registry will recognise the 'leapfrog'.

PS I have an idea of the conveyancing process, rather than of the Italian.
Example sentence:

E&W: A court order sent to conveyancing counsel under paragraph 6.4 will be sufficient authority for him to prepare his report or draft the document (conveyance).
