it's a disagreement about an application to register a trademark. Full sentence is: "les tentatives pour mettre fin au litige en phase extrajudiciaire étant restées vaines, xxx a assigné en justice.... pour obtenir – après constatations et actes déclaratoires à la cause – le transfert judiciaire de l’enregistrement de marque".
The text is actually a translation of an Italian text so the French is a bit odd at times (though perhaps not here). Any help gratefully received!

: no, what is needed is nouns, as in the French and a party does not have to ascertain or declare his case, he has to prove it
