This appears on a ruling from a Court of Appeal in France.

Lors du prononcé de l'arrêt
Il a été donné lecture de l'arrêt par le président en présence du ministère public et de Madame XX

I have found several possible translations, including counsel for the prosecution, district public prosecutor, assistant public prosecutor, but I am not sure which is correct!

FHS Bridge says "Solicitor-General", but I don't think France has an equivalent, and s/he wouldn't attend a mere sitting of a Court of Appeal anyway, if the position did exist.

The US has an Attorney General I believe, the senior lawyer in the country, to oversimplify.


France obviously doesn't have Queen's Counsels (QCs), so that's why Public is in there -- Public = representing the people.

Yes, there is a slight shade of meaning between deputy and assistant, assistant is better. Thanks Chris!

I would use reverse logic: if the Assistant Public Prosecutor is present in court for the ruling and that's a fact worthy of mention in the ruling, then it's a [edit] criminal case. Only thing that makes sense. Thanks Adrian!

I originally found the term in a PT>EN legal glossary organized by a translator. The Brazilian legal system is very similar to the French one (civil law).

L'"Avocat général" n'est pas un membre du Barreau. "Avocat général" est la dénomination donnée à la fonction qu'exercent certains magistrats du Parquet établi auprès de chaque Cours d'appel et auprès du Parquet de la Cour de Cassation (art. R132-1 du Code de l'Organisation judiciaire). Ils exercent leur fonction sous le contrôle du "Procureur Général" qui dirige le Parquet de la Cour.

Les tâches qui incombent aux Avocats généraux près la Cour de Cassation sont exécutés sous la coordination des "Premiers Avocats généraux" et l'ensemble de ces magistrats est dirigé par le chef de service du Parquet de la Cour. Le décret n° 2008-818 du 21 août 2008 a institué des Avocats généraux référendaires près la Cour de cassation.

Décret n°2015-1458 du 10 novembre 2015 relatif aux exceptions à l'application du principe « silence vaut acceptation » sur le fondement du II de l'article 21 de la loi n° 2000-321 du 12 avril 2000 relative aux droits des citoyens dans leurs relations avec les administrations (ordres professionnels).
