المادة السادسة اتفق الفريقان على انه يبقى للفريق الأول حق انشاء ما يشاء من الابنية على السطح الاخير للبناء وباي طريقة او وسيلة تمكنه من ذلك وفقا لقانون البناء الحالي او القوانين اللاحقة مع حق افراز هذه الانشاءات الجديدة وبالتالي وانفاذا لما تقدم فان الفريق الثاني قد تنازل واسقط حقه منذ الان بكل ممانعة أو معارضة او ادعاء او مداعاة تتعلق بهذا الخصوص ومؤكدا بأن كافة حقوقه له لما فعل هذا العقد انما محصورة بالشقة المباعة المتعاقد عليها ولا تتعداه بالسطح الاخير من البناء وقد فوض الفريق الثاني الفريق الأول للقيام بالتوقيع على تعديل نظام الملكية المشتركة واجراء معاملات اضافة الانشاءات والافراز والخرائط اللازمة وتعديل نظام الملكية المشتركة وتوقيع وتسجيل الانشاءات المضافة على اسمه في الدوائر العقارية لانها ملكه واشادها من مال الفريق الأول الخاص وليس للفريق الثاني اي حق او علاقة بها مبرئا ذمته بالخصوص المذكور وله مطلق الحق بالتصرف هذه الانشاءات المضافة لمن يشاء ويريد لحسابه ولمصلحته منفردا وقبض الثمن والاقرار والابراء واتمام كل ما يلزم في هذا الموضوع محتفظا بكامل حقوقه في السطح الجديد بعد الاضافة منذ الان دون حاجة لحضوره او موافقته مجددا.
