К условиям для обеспечения исполнения обязательства заемщиком применяются правила о замене предмета залога. Так, при гибели предмета залога, изъятии его из гражданского оборота или если залогодатель на законных основаниях лишен права собственности на предмет залога, последствия, предусмотренные комментируемой статьей, могут наступить только в случае, когда залогодатель отказался восстановить или заменить его равноценным имуществом, если он не лишен этого права условиями договора залога.

There's no such thing as "subject of pledge" Not in actual English, that is. Depending in your general context, you may want to refer to this "subject" as "property pledged/mortgaged" or simply as "collateral. Nor is there such a thing as "civil circulation" in English finance speak. By definition, all financial "circulation" is "civil," except where a crime is involved. In an actual text in English, they would most likely say "withdrawing the collateral," except that in itself sounds fairly weird since under most mortgages or other secured loans, you cannot simply "withdraw" the collateral, and you don't. Your lender would most likely require that you insure the asset pledged as collateral in case it gets destroyed though, designating the lender as the beneficiary.

Confirm with a banker, though, if this makes sense.

disagree The Misha : You are missing the point here altogether. It's not the money that is "being taken out of circulation" but rather the collateral/security you have to post to be able to borrow that money. How do you take money out of circulation anyway?
