وحيث إن محافظ محافظة واسط قد اقام الدعوى بالإضافة إلى وظيفته رغم إقالته عن منصبه من قبل مجلس محافظة واسط لذا تكون خصومته في الدعوى غير متوجهة إليه ( المادة(4) من قانون المرافعات المدنية رقم ٨٣ لسنة ١٩٦٩ المعدل) وإذا كانت الخصومة غير متوجهة تحكم المحكمة ولو من تلقاء نفسها برد الدعوى دون الدخول في أساسها استنادا للمادة (80) من قانون المرافعات المدنية لذا قررت المحكمة الاتحادية العليا الحكم برد الدعوى مع تحميل المدعي مصاريف الدعوى كافة وصدر الحكم باتا وبالاتفاق استنادا لأحكام المادة (٩٤)من دستور جمهورية العراق لعام ٢٠٠٥ وافهم علنا في؛ 14/2/2017 .

I have translated the above paragraph in English:
Since the Commissioner of the District Wasit has filed the suit referring to his position as Commissioner in spite of the fact that he had resign from his position, therefore, his suit cannot be admitted for hearing under Section-4 of the Procedural Law No.83 of 1969. Where a suit is not admissible for hearing the court may suo mot dismiss the case without going into it details in accordance with Section-80 of the Code of Civil Procedure. Therefore, the Supreme Federal Court has dismissed the case with ordering that the plaintiff would be liable for the costs of litigation in accordance with Article-94 of the Constitution of the Republic of Iraq of 2005.
