From my humble point of you, I understand "موضوعية" as objective, which is in legal terms "factual" or "of fact".
I would use "De Facto", which is the latin term used in Courts to describe facts.

I agree with defences but not with subjective. the context speaks of substantive defences in opposition to procedural defences. Substantive is defined in Oxford online dictionary as; (Of law) defining rights and duties, as opposed to giving the procedural rules by which those rights and duties are enforced
