والولاية بفتح الواو وكسرها، ويقصد بها: أن يتولى الكبير الراشد تدبير شئون القاصر الشخصية والمالية، والقاصر: من لم يستكمل أهلية الأداء؛ سواء كان فاقدًا لها كصبي غير مميز ومجنون، أم ناقصها كصبي مميز ومعتوه ومحجور عليه بسفه. والولاية نوعان: ولاية على النفس، وولاية على المال، والولاية على النفس: هي الإشراف على شئون القاصر الشخصية من صيانة وحفظ وتأديب وتعليم وتزويج، والولاية على المال: هي الإشراف على شئون القاصر المالية من استثمار وتصرفات كالبيع والإجارة والرهن وغيرها.
