Hi there -

I am translate a court document where a case is being tried on appeal. The lawyer for the defense uses this phrase and I am not sure how to correctly translate it.

Infine, dal punto di vista strettamente tecnico-processuale, l'omissione radica un vizio di nullità della sentenza, scaturente dalla mancata considerazione di un'importante allegazione difensiva; nullità che, pur giuridicament indiscutibile, in questa sede si manca di eccepire in senso formale per l'unica ragione che, come noto, nella procedura estradizionale l'Ecc.ma Corte è giudice anche del merito, e dunque potrà - e dovrà, mi permetto - affrontare l'argomento per la prima volta ed ex professo, rimediando alla completa inerzia del Giudice territoriale (cfr., mutatis mutandis, Cass. VI, 30 novembre 2017, No. 58094).
